Standard commercial and engineering terms governing structural steel detailing contracts, RFQ proposals, 3D BIM coordination, deliverable transmittals, and client partnerships with Marvix Steel Solutions.
These Terms of Service ("Terms") constitute a legally binding agreement between you (the "Client", "Fabricator", or "Customer") and Marvix Steel Solutions Private Limited ("Marvix Steel", "we", "us", or "our"), with corporate headquarters at 1712 FOUNTAIN VISTA VW, WYLIE, TX 75098, United States.
By executing a Purchase Order (PO), issuing a Notice to Proceed (NTP), signing a detailing proposal, or submitting project drawings through our web portal (marvixsteel.com), you acknowledge that you have reviewed, understood, and agreed to these Terms in their entirety.
Section 02
Engineering Services & Detailing Scope
Marvix Steel provides specialized structural engineering and steel detailing solutions, including but not limited to:
Structural Steel Detailing: Columns, beams, trusses, bracing, girders, base plates, and moment frames modeled in Tekla Structures and SDS2.
Miscellaneous Steel Detailing: Egress stairs, monumental switchback stairs, OSHA/IBC handrails, cage ladders, elevator divider beams, roof frames, canopies, and grating.
3D BIM Coordination & Clash Detection: Multi-trade federation via open IFC and Navisworks formats to eliminate MEP and architectural collisions before steel fabrication.
Connection Design & Delegated Engineering: Structural connection calculations stamped by licensed Professional Engineers (PE / SE) across US states and Canadian provinces when contracted under scope.
Precast & Rebar Detailing: Precast wall panels, spandrels, embed placements, and bar bending schedules.
Section 03
RFQ Quotations & Project Kickoff
Written proposals issued by Marvix Steel specify tonnage estimations, modeling platforms (Tekla or SDS2), turnaround schedules, and lump-sum or per-ton rates based on architectural and structural contract drawings available at bid time.
Quotation Validity: Detailing proposals remain valid for thirty (30) calendar days from issuance unless otherwise designated in writing.
Notice to Proceed (NTP): Work commences upon receipt of an executed proposal, signed purchase order, or written authorization alongside complete, legible contract drawings (structural, architectural, and relevant addenda).
Section 04
Standard Suite of 16 Fabrication Deliverables
Unless specifically modified in the proposal scope, every detailing package produced by Marvix Steel includes our complete standard suite of 16 fabrication-ready deliverables at no extra charge:
Quality and constructability depend on systematic communication between detailers, fabricators, and the design team:
For Approval (FFA) Submittals: Anchor bolt layouts, erection diagrams, and typical shop drawings are submitted for approval to the fabricator, General Contractor, and Engineer of Record (EOR).
RFI Protocol: When contract drawing discrepancies or missing connection data arise, Marvix promptly submits formal Requests for Information (RFIs). Timely turnaround of RFIs by the design team is necessary to maintain delivery milestones.
For Fabrication (FFC) Release: Drawings are released for shop fabrication only following receipt of formal approval (e.g., "Approved as Noted" or "Approved") from the client or EOR. Fabrication performed prior to approval release is strictly at the client's sole discretion and risk.
Section 06
Scope Changes, Bulletins & Revisions
Design changes issued subsequent to bid documents (including architectural bulletins, revised structural drawings, or late addenda) represent changes in scope:
Change Order Transparency: If revisions impact completed 3D modeling, detailed shop drawings, or connection calculations, Marvix Steel will provide an itemized Change Order detailing the required drafting hours and schedule impact before proceeding with back-drafting.
Detailer Error Rectification: Legitimate detailing errors or internal oversights identified during fabrication or erection review are corrected immediately by Marvix Steel at zero additional cost to the client.
All building designs, architectural drawings, and client-provided bid documents remain the sole and exclusive intellectual property of the Client. Upon full payment of all contracted invoices, the Client owns full rights to the delivered fabrication drawings and CNC data files for that project.
Marvix Steel retains ownership of its proprietary internal detailing macros, customized automated Tekla plugins, standard parametric connection scripts, and internal QA checklists developed to streamline shop output.
Section 08
Industry Codes & Quality Protocols
All detailing output is executed in accordance with North American and international structural standards:
AISC: American Institute of Steel Construction Code of Standard Practice (AISC 303) and Specification for Structural Steel Buildings (AISC 360).
NISD: National Institute of Steel Detailing Industry Quality Standards.
CISC: Canadian Institute of Steel Construction / CSA S16.
AWS: American Welding Society Structural Welding Code (AWS D1.1).
OSHA: Safety provisions for steel erection erection seats, double connections, and column stability.
Section 09
Limitation of Liability & Professional Review
Marvix Steel exercises professional engineering diligence and rigorous 5-tier quality control over every drawing. However, structural steel detailing serves as an interpretation of the Engineer of Record's design.
In no event shall Marvix Steel Solutions be liable for indirect, incidental, consequential, special, or punitive damages—including loss of project profit, delay claims, crane standby fees, or field rework charges—arising from fabrication initiated without proper approval or verification by the Engineer of Record. Our maximum aggregate liability under any contract shall not exceed the total fees paid to Marvix Steel for detailing services under the applicable purchase order.
Section 10
Invoicing, Payment Terms & Retainage
Standard payment milestones are structured logically around project progress:
Milestone Breakdown: Typically 20% on Anchor Bolt & Advance BOM release, 40% on Submittal for Approval (FFA), and 40% on Release for Fabrication (FFC), or monthly progress billing on large tonnage contracts.
Payment Window: Invoices are payable within Net 30 days from transmittal date unless specifically contracted otherwise in the proposal.
Currency: North American contracts are denominated and payable in United States Dollars (USD).
Section 11
Governing Law & Dispute Resolution
These Terms and any project contracts executed with North American fabricators shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any legal action or dispute arising hereunder shall be subject to the exclusive jurisdiction of the state and federal courts located in Collin County, Texas.
